Federal Court Halts VIM Sales Over Patent Infringement Claim
GREENWICH, CT—April 15, 2009—Presstek, Inc., a leading manufacturer and marketer of digital offset printing solutions, today announced that a United States District Court has issued a permanent injunction barring a U.S. based distributor from selling, distributing, soliciting, advertising and servicing printing plates manufactured by VIM Technologies, Ltd. The injunction was ordered as a result of a patent infringement claim initiated by Presstek, Inc. the owner of the patented technology, and is the result of a settlement.
The injunction, entered by the United States District Court for the District of New Hampshire on March 30, 2009, brings to a successful conclusion one of several patent infringement claims initiated by Presstek in various jurisdictions against VIM Technologies, Ltd., an Israeli-based manufacturer, and its distributors. This is the second Order that Presstek has obtained against a U.S. distributor barring the sale of VIM printing plates. Presstek also has patent infringement claims pending against VIM and against several other VIM distributors, including Spicers Paper, Inc., Recognition Systems, Inc., Guaranteed Service & Supplies, Inc., and AteCe Canada.
In commenting on the recent injunction Presstek’s General Counsel, James R. Van Horn said, “We have aggressively pursued these actions against VIM and its distributors to protect Presstek’s valuable patented technology. Our objective is to end the unlawful sale and use of the infringing VIM products and to recover damages from the manufacturers, distributors and, in some cases, the end-users of these products.”
The injunction was entered in the case of Presstek, Inc. v. Joseph Musgrave and Prograf Digital Service, Inc., in the United States District Court for the District of New Hampshire, Civil Action No. 1:08-cv-00512-JM.
