Presstek Claims Victory in Patent Lawsuit
HUDSON, NH—Presstek Inc., a supplier of digital offset printing solutions to the printing and communications industries, announced that the Higher Court Dusseldorf, Germany, has upheld a Regional Court decision finding Israeli manufacturer VIM Technologies in violation of Presstek’s German patent (DE 693 29 365 T2).
According to Presstek, the court has ordered VIM and defendant Reinsch Handel to immediately cease and desist from selling any of its infringing printing plate products in Germany. VIM has also been ordered to provide to Presstek detailed information on all sales of the infringing products in Germany for a six-year period.
The plates at issue in the proceeding were the VIM DP-R28 and DP-R36 lithographic printing plates.
In a separate proceeding, the Patent Court in Munich, Germany, has found that the patent that Presstek has asserted against VIM in the infringement case to be valid and enforceable. Presstek reported that the judgments of the Higher Court Dusseldorf and the Patent Court are final, because the time to file appeals has expired.
The company also announced that as a result of these court findings, Presstek will be pursuing the enforcement of its patents against other distributors of VIM products throughout Europe where distributors are selling VIM products in violation of Presstek’s patent rights.
